Lawsuit Over Lip Balm

On several sites that I have written on in the past, I have written about some “frivolous” lawsuits in the past.  It seems that people nowadays will sue over anything and every thing.  It probably started when the person sued McDonald’s when they spilled their hot coffee in their lap resulting in burns.  To me, any one with common sense would know that HOT coffee if spilled may cause burns.  So since one person made that mistake and got hurt, McDonald’s (and I’m sure other businesses) had to “warn” people that their hot coffee, if spilled may cause damage!!  People will sue over anything for the money, apparently no matter how ludicrous the lawsuit maybe, there’s always a lawyer out there willing to sue and get their client money.  It’s all about money!!

 

Some of these cases, even though the lawsuit seems so preposterous the claimant actually wins the case. However not in the case of this lawsuit.  Apparently some one tried to sue a company over lip balm.  The claimant is claiming that the lip balm company is swindling people out of lip balm!!!  Yeah, they claim that they don’t get ALL the lip balm that they’re paying for!!  To see what I’m referring to go to this link http://www.instituteforlegalreform.com/resource/court-tosses-lawsuit-over-lip-balm-left-in-tube–

 

I can relate to this client!!  When you buy a bag of chips or anything that is packaged and it “appears” that there is more AIR in the package than the actual product!!  According to this article though, that AIR in a package is “slack fill.”  The company that is packaging the product has to leave some room for the product and in some cases to product the product from damage.  I’m sure the product itself is weighed before it’s packaged for the correct weight anyway!!

I remember when there was talk about New York going to ban cups of larger than 16 ounces of pop.  You couldn’t hardly find any big pops, but yet the store was selling smaller sizes at the same price as the big ones.  Surprise that there weren’t lawsuits then, because you “definitely” weren’t getting what you were paying for!!

Good to see this frivolous lawsuit was thrown out!!
